The choice to consume alchohol is in your hands. If you don't want to be at risk of getting a DUI, then just don't drive the nights you drink. Nobody secretly spiking your gatorade or forcing you to consume alcohol and then drive your car shortly thereafter.

Just like anything else that is governed by rules, if you try to push or test the rules/laws, you openly introduce the possibility of getting into trouble.... It's as the old saying goes "If you play with fire, you eventually get burned".

Try to look at this situation from the perspective of all of society rather than just from your own personal view... and realize that these DUI laws do a whole lot more of good for every person in this country than they do bad. They aren't going to go away, so you'd better get used to them.

I for one, am glad that they are there... and I think that many individual police officers are already pretty lenient on drunk driving. Every weekend when I'm coming home from hangouts with my friends or bars/clubs, I see at least 1 or 2 drunk drivers on the road swerving all over the place and driving onto the dirt shoulder of highways... it's not a comforting thing to see.

Just be glad that we don't have a Zero Tolerance policy for drivers over the age of 21.

Because if we had a Zero-tollerance policy for all drivers, then anyone who drove a car with even a .01 or .02 BAC could be liable for license suspension if an officer were to pull you over and issue a breathalyzer test to you.

This is the way the law works for minors(under age of 21). If you are under 21 and get pulled over by a cop and you blow a .02 on the breathalyzer, you are supposed to lose your license... no matter what.

Most likely no. But my plan is if I'm over the limit I'd probably stay in the car and sleep or something until I get under the limit. The Air Force is really strict on DUI's and I'm not going to get caught for it.

Just make sure that the keys is not in the ignition (might even want to hide it), because po-po call still get you for DUI even though you're not driving.

My bro got caught after he pulled over for his chick to puke on the side of the road and they didn't even see him driving. And they said that if the keys are w/i 30' of the car, they can still get you for DUI.

That's a good point.

I had a cop give me a breathalyzer one night when we were in a Dunkin Donuts parking lot and just sitting in the car with it off(my friends were drunk, I hadn't drank anything).

Word on the street is that the cops can slap you with a DUI for just having the keys in the ignition. How true that is... I don't know. But that's what everyone I know says.

I don't want to sound like He-Man or anything, but I can drink 1 beer on the hour for 12 hours and still be able to recite my ABC's backwords...

The problem with doing skill tests to determine ones ability to drive is that it's very arbitrary. It leaves it up to a police officer to determine if he considers you drunk or not based on his evaluation of your performance. I would think that it's a lot easier to prosecute a drunk driver if you have a static number such as a .80+ reading on a breathalyzer machine to use as evidence rather than a police officer saying "The guy looked a little woozy and couldn't recite his ABC's backwards". Some people can't even recite them backwards on their best day... and a driver might appear to be drunk just because he is tired, but being tired won't make you blow above the legal limit on a breathalyzer test... unless your reason for being tired is that you were up all night drinking.

i think if you pass all tests then you should be let go.
if you fail those tests. then you ARE drunk AND should be breathalized. I WILL NOT ARGUE THAT.
but i passed all mine-- then he says "come over here" then he brings out a breathalizer and says "i need you to blow into this" i said "after all of that, i need to do this too?" (asking him a question... i thought it was redundant and i don't trust those machines) he freaks out right away.. SLAMS me into the car. screams to the other officer "he's refusing! he's refusing!!" i said "no, i asked a question..." then said "i'll do it, i'll do it."
he says, "no it's too late for that" they handcuff me and throw me in the car and tow my car.
i honestly did not know my rights....
after he drove me back i did it there. (breathalyzer)

fucking pigs on their power trips.

Most police officers have an on board camera, so what you do is have your lawyer request a copy of that to see what really happened...

yeah well he said if i wanted a serious trial like that.. it would be much more $$ plus it would make it much harder on me. no ARD program etc. basically i'd get screwed for asking and discussing the "truth"

whatever. law enforcement/govt/lawyers are crooked (not all tho)

Well you can get the tapes to prove if your rights were violated without going to court...this would dismiss the charges immediately...
