Unless you weigh like 80 pounds you shouldn't have been able to blow a .13 on 4 drinks in 4 hours.

i was .11
but yeah thats what i thought. i even talked to my lawyer about having records pulled for the breathalyzer machine. he said if they did, and it was shown to be accurate - i would be facing much worse charges.
how's that for "land of the free"
but plus, like i said.. i did research and found that the drinks i had were much higher % basically 7-8% as opposed to the average of 3.5% so i guess i technically had 7-8 drinks then... even tho i really had 4

whatever... its all BS.

i can't grasp having such strict laws for something that is not obvious. ie. -- all cars have speedometers... i can see my speed. i CANNOT see my BAC and even if i buy a tester... it "may not" be accurate and that would not even hold up. i still think the system is BS... but i don't have a better solution, so i have no right to complain.

Then don't risk it.

If absolutely must drive.... play it safe and don't drink more than 2 drinks and always wait at least an hour before driving after having your last drink. Eat some food too before you drive and give it some time to get into your system.

Sure the law might annoy you, but I don't think the it's is absurd or BS at all. It's put there for a reason.. to protect people. Plenty of people still die every year, even with the law in place.. and I bet it would be much worse if the law wasn't there at all.

Do you want to know what's Bull-shit? 17,013 people died in 2003 as a result of alcohol related traffic accidents in the U.S.

If you can't abide by the DUI law, then you either shouldn't be drinking or you shouldn't be driving.

If you really insist on cutting it close with the blood alcohol limit, then the only suggestion I can give you is to go spend the 100-200 bucks on a higher quality breathalyzer. But even if you are .07, don't think that it doesn't impact your ability to operate a vehicle... because it absolutely does, regardless of whether the law says your drunk or not.

oo and even worse... lets not forget all of the variables:

body weight, when you ate, what you ate, how much you ate, what type of drink you drank.

NOONE can accurately judge the difference of a .07 to a .09

for such stiff penalties and such a serious crime, there are way too many factors.

PLUS. alcohol effects how people feel differently. not just weight either. they talk weight, weight, weight.
but say i'm drinking with a 250 pound guy that is a '2 beer queer'
say we both have 4 drinks. i may feel FINE, he may feel buzzed. because HIS BODY REACTS DIFFERENTLY --- ALL BODIES DO.
but you go totest the BAC
bc of the weight (i weigh 185) say i blow a .11 (which is high for 4 drinks, but thats what i blew)
and he blows a .07 bc hes a fat ass. but hes feeling it more than me, for whatever reason.

HOW IS IT "FAIR" THAT TWO PEOPLE DRINK THE SAME EXACT THING IN THE SAME EXACT AMOUNT OF TIME - HAVE COMPLETELY DIFFERENT RESULTS????

Again for those drinking and driving, you need to think of the consequences of your actions. There are many who think the same as you. One case down here involved a veteran police officer. He knew the risks, he drove drunk, and he killed a girl.

What makes driving while intoxicated (either totally toasted or mildy impared) worth the potential outcomes? Take a friken cab or get a friend to drive.

I think when they say "One drink", they're referring to 1 beer, or 1 normal mixed drink at a bar(such as a rum and coke), once again.. solelyl for generalizations purposes.... and this doesn't take into account stronger drinks such as a Long Island Iced tea, or whatever drink might have a higher alcohol content than what is contained in a 12 oz, bottle of beer.

Nowhere does the law saw "one drink per hour". It's just what people say to give you a general idea.

well supposily as long as you pull over in a place that's not a towzone...they can't tow you. My friend pulled into a hotel parking...and the staff there were kind enough to not tow and the SF police ask them to not tow as well. I mean, they were actually nice about it.

And yes my friend was stupid for doing it. He accepted his responsibilites. I didn't even know he was drunk-- I mean legally... it changed my whole perspective. I wish it didn't have to take something like this, but I'm more aware of the dangers and doubt I'll be drinking excessively anymore (even as a passenger) and if I'm driving from now on, I'm not drinking anymore....that's a promise-- because I realized that there's no way for me to tell how much is .008 for me.

Life's not fair...WTF? People's bodies react differently to the effects of alcohol. What you consider drunk might be sober to me and vice versa...I personally can drink a 12 pack without a problem because I drink so much anyways...yet my BA would probably put me as legally drunk. Everyone has a different trigger level and that raises with the amount you drink and frequency. So is it fair...life is not fair, get over it...

no it's not fair and i won't get over it.

like i said we have no way of knowing. i could go out and have 2 glasses of wine for Valentine's dinner. blow in my trusty tester that you all recommened. blow a .06 drive home get pulled over bc the pig is jealous of my car. and his shows a .08 i could then blow in mine again.. read a .06 -- but it would not matter. i would be FUCKED.

no, i won't get over it. it's a bad system. there should be more leniancy for low BAC.

do they penalize people driving on medication??? do they say "oo you look woozy. what medication are you on? let's do some bloodwork"
half you fuckers on the road can't drive as it is...

Well, after reading this thread I decided to buy one of the best breathalzer on the market. http://cgi.ebay.com/ws/eBayISAPI.dll...MEWN%3AIT&rd=1 It's like $130-$160 retail but I got it for $70 on ebay. I read some good reviews about this and happy that I'll be able to test myself before I drive. $70 for a breathalyzer might be a little steep but if you think about it it's A LOT cheaper than getting a DUI.
