I believe this is a loophole in several states. I know in Virginia that if the trooper doesn't have you sign the ticket, then you get a free pass. Do you know if this is the only state in which the loophole was fixed.

This was in this morning's paper (Star Ledger) and said it was at the state level. It was a loophole that attorney's had been using to get tickets dismissed.

WTF ... I never knew about this loophole ... I could have gotten out of my first & only speeding ticket years back if I knew this. Arg

If the officer is questioned properly, this might be an acquittal (the license plate issue, specifically). The key thing is to challenge the officer's recollection during his testimony. Be sure, though, to get a copy of all the officer's notes - specifically, a copy of both the front and back of HIS copy of the ticket - before you go to trial.

Actually, if you're considering contesting a ticket, go to www.motorists.org and order the Legal Defense Kit. It's definitely worth the expense.

Under normal circumstances, if any information is wrong the ticket can be dismissed. Can anyone verify this, GARD?

Not true. Just another old wives' tale. There are no "magic bullets" which will result in a dismissal. Sure, discrepancies on the ticket can be used to discredit the officer's testimony, but there simply is no foundation for saying that ANY incorrect information on the ticket would produce a dismissal. It all comes down to the credibility of the officer and whether he followed the appropriate procedures/protocols for the use of his speed detection apparatus. If you aren't able to either discredit the officer's testimony, or show he used his speed detection equipment improperly (or wasn't properly trained or certified), you're highly unlikely to prevail.

Sheesh.
